Shoulder Injury Related to Vaccine Administration “SIRVA” Attorneys

Did you receive the flu shot or vaccination? Are you experiencing pain and stiffness in the shoulder where you received the shot? Have you been diagnosed with a shoulder related injury?

If so you, you have legal recourse and may be entitled to compensation.

A Shoulder Injury Related to Vaccine Administration (“SIRVA”) generally refers to pain, weakness, and/or a limited range of motion in the arm where the vaccine was administered. Common shoulder injuries related to improper vaccine administration include, but are not limited to, tendonitis, impingement syndrome, frozen shoulder, adhesive capsulitis, and rotator cuff tears.

A person who suffers a shoulder injury after vaccination may be entitled to recover compensation through the National Vaccine Injury Compensation Program (“NVICP”). The NVICP is no-fault federal program established by Congress to compensate individuals who suffer vaccine-related injuries, including shoulder injuries.

Individuals who suffer a qualifying vaccine injury, including SIRVA, must file a vaccine injury claim with the United States Court of Federal Claims, Office of Special Masters in Washington, D.C. Compensation for a vaccine-related injury.

The vaccine program has a strict three-year statute of limitations for vaccine injuries that do not result in death. The limitations period begins to run from the calendar date when a person first experiences the onset of the very first symptom related to his or her vaccine injury.

To maximize your chances of a full and successful recovery, it is advisable to retain a qualified vaccine-injury lawyer to evaluate your case, guide you through the process, and represent you in vaccine court.

The NVICP pays a claimant’s attorney’s fees and costs for filing a vaccine injury claim provided there is a reasonable basis for the claim that is maintained throughout the pendency of the case. Accordingly, we will not bill for attorney’s fees or ask for a retainer to cover the lawyer’s time.

The amount of compensation you can recover for SIRVA depends on several factors, including the significance and duration of your injury, the adverse effect it has had on your work and life, your treatment with medical providers, and the extent of your disability, if any. A qualified vaccine-injury lawyer can evaluate the potential value of your case.
