Every state has certain time limits, called "statute of limitations" that govern the period during which you must file a personal injury lawsuit. In Massachusetts, you may have as much three years to file a claim; however, if the suit is against a city, you have only thirty (30) days to notify the city that you were injured and intend to pursue a claim against them. The time it takes to settle a claim depends on many circumstances. It is important to allow injuries to stabilize before beginning settlement negotiations. By settling too early, important consequences of a serious injury may be missed, such as the need for future medical treatment, scarring, or rehab difficulties. When the treating physician issues a final medical report stating the diagnoses of the injuries and their opinion as to the prognosis, the evaluation of the case for settlement can begin. Once a demand has been submitted to the insurance company, it may take 4-6 weeks for the company to review it before negotiation may begin. However, in more complicated cases, the time may take substantially longer.

Will my medical bills be paid for? top
If you are injured in an automobile accident, $8,000 of your medical bills are covered under Personal Injury Protection (PIP). If you have health insurance, the first $2,000 will be paid by PIP, and the remaining medical bills will be paid by your health insurance. If you have more than $8,000 in medical expenses, the bills may be deducted from your settlement. Frequently, we are able to get your medical provider to reduce the amount of the remaining medical bills that are not covered by PIP.
If your injury is a result of a general liability accident such as a slip and fall, then medical bills may sometimes only be recoverable once a settlement has been reached. In some circumstances, however, there may be medical pay provision in the insurance policy to cover your medical bills. Naturally, each accident and policy coverage will differ.Related Topics
